Terms of Service

Last updated October 12, 2026
These terms are a contract between you and BlueCollar ("BlueCollar", "we", "us"). They cover your use of the BlueCollar apps, website, and services. We've written them in plain English on purpose — if something here is unclear, email us at support@bluecollarapp.ai before you sign up. Please read "Governing law and disputes": it requires disputes to go to individual arbitration instead of court or a class action, unless you opt out within 30 days.

1. Agreeing to these terms

By creating an account, starting a trial, or using BlueCollar, you agree to these terms. If you're agreeing on behalf of a business, you're confirming you have the authority to bind that business, and "you" means that business.
You must be at least 18 years old. BlueCollar is built for business use, not personal or household use.

2. What BlueCollar does

BlueCollar gives your business an AI assistant with its own phone line. It answers calls and texts, collects job details, books appointments, drafts estimates and invoices, and follows up with your customers. Everything it does shows up in your app for you to review.
Some important limits on what we are:
We are not an emergency service. The AI cannot dispatch police, fire, or medical help, and the number we provide must never be used or advertised for emergencies.
We are not a licensed professional. Estimates, pricing suggestions, and scheduling are software output, not professional, legal, tax, or financial advice.
We do not guarantee that every call is answered, every message is delivered, or every booking is correct. Phone and messaging networks fail sometimes, and AI makes mistakes.

3. Your account

Give us accurate information when you sign up and keep it current. You're responsible for everything that happens under your account, including what your employees or crew do with it, and for keeping your password secure. Tell us promptly at support@bluecollarapp.ai if you think someone else has gotten into your account.

4. Plans, free trials, and billing

Paid plans are billed monthly in advance through Stripe. Current pricing is on our website and may change; if we raise the price of your plan, we'll tell you before it takes effect and you can cancel.
Starter includes a 14-day free trial. We collect a card at signup but do not charge it during the trial. On day 14 the plan converts to paid automatically unless you cancel first.
Growth and Pro begin billing when you subscribe — they do not include a trial.
Subscriptions renew automatically each month until you cancel.
You can cancel anytime from Settings. Cancellation stops the next renewal; it does not refund the current period. Cancel during a Starter trial and you are never charged.
Except where the law requires otherwise, payments are non-refundable and we don't prorate partial months.
If a payment fails, we may retry it and may suspend or downgrade your account until it clears.

5. Your phone number and usage charges

We provision a phone number for your business through our telephony provider. You get the exclusive right to use that number while your account is active, but you do not own it, and numbers we assign may not always be portable to another provider.
Calls and messages consume prepaid balance on your account. If your balance runs out, your line may stop answering until you top up. If you close your account, we may release the number for reuse — if the number matters to your business, ask us about porting before you cancel.

6. Calls, texting, and consent — your responsibilities

This is the most important section in this document. You — not BlueCollar — are the caller and the sender of every message your line sends, and you are responsible for following the laws that apply to them.
Messaging consent: you must have the recipient's consent before texting them, honor opt-out requests such as STOP immediately, and comply with the Telephone Consumer Protection Act and any other applicable rules. Do not import contacts who have not agreed to hear from you.
Call recording: calls to your line may be recorded and transcribed so the AI can work. Recording laws differ by state — some require every party to consent. You are responsible for making sure the required disclosure and consent are in place for the states you operate in.
No prohibited use: no robocalling, spam, harassment, deceptive or fraudulent messages, unlawful content, or anything that violates carrier or messaging-platform rules.
Accurate identity: do not use the service to impersonate another business or person.
AI disclosure: your assistant tells callers it is an AI assistant and that the call may be recorded, and it stops recording when a caller asks. Do not change its greeting or instructions to hide either fact or to claim it is a person — several states require that disclosure.
We may suspend a line immediately if we receive carrier complaints or believe it's being used unlawfully.

7. AI output — review before you rely on it

The AI generates text, estimates, prices, and bookings automatically. It can be wrong, and it can misunderstand a customer. Review anything that carries money or a commitment — estimates, invoices, and scheduled appointments — before you rely on it or send it. You remain responsible for the work you quote and the promises made to your customers.

8. Getting paid by your customers

BlueCollar does not process your customers' payments and never holds their money. When you connect a payment account, your customers pay you directly through Stripe under Stripe's own agreement with you. Refunds, chargebacks, disputes, and sales tax on the work you do are between you, your customer, and your payment processor.
If you sell maintenance plans or other recurring charges to your customers, you are the seller: you are responsible for disclosing the price, renewal terms, and how to cancel, and for honoring cancellations, as the automatic-renewal laws of your customers' states require. Quotes, invoices, and agreements your customers sign electronically through BlueCollar are agreements between you and them; we provide the tool and keep a record of the signature, but we are not a party to them.

9. Your data and your customers’ data

You keep ownership of your business data and the customer records you put into BlueCollar. You grant us the license we need to host, process, transmit, back up, and display that data in order to run the service.
For the personal information of your customers, you are the controller and we act as your processor — we handle it to provide the service to you. You're responsible for having the right to give us that information in the first place. Our Privacy Policy explains what we collect and who we share it with.

10. Acceptable use

Don't do these things with BlueCollar:
Break the law, or help someone else break it.
Reverse engineer, scrape, resell, or copy the service, except where the law says you may.
Interfere with the service's operation or security, or try to reach data that isn't yours.
Share your account with another business, or use one account to run lines for unrelated companies without our written agreement.
Upload malware, or content you don't have the rights to.
Post reviews, photos, or claims on your public page that are false, that you don't have permission to use, or that you wrote or paid for while presenting them as independent customer reviews.

11. Copyright complaints

Businesses can publish content through BlueCollar, such as their public page, photos, and reviews. If you believe something on BlueCollar infringes your copyright, send a notice to our copyright agent at support@bluecollarapp.ai (subject line "Copyright notice") that includes:
Your physical or electronic signature, name, address, phone number, and email.
The copyrighted work you say is infringed, and the link to the material on BlueCollar.
A statement that you believe in good faith the use isn't authorized by the owner, its agent, or the law.
A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
We'll remove or disable the material and notify the business that posted it, who may send a counter-notice. We terminate the accounts of repeat infringers.

12. Beta features

Features we label beta, preview, or early access are still being tested. They may change, break, or be withdrawn without notice, and they're provided as-is with no commitment that they'll stay available.

13. Our intellectual property

We own the BlueCollar software, brand, and everything we've built, apart from your data. These terms don't transfer any of it to you — you get a limited, non-exclusive, non-transferable right to use the service while your account is in good standing.
If you send us feedback or ideas, we may use them freely and without owing you anything.

14. Services we rely on

BlueCollar runs on third-party services, including a telephony carrier, AI model providers, Stripe for payments, and cloud hosting. Their outages and changes can affect the service, and their terms may also apply to you. We're not responsible for third-party services we don't control.

15. Suspension and termination

You can stop using BlueCollar and cancel at any time. We may suspend or terminate an account that breaks these terms, doesn't pay, or creates legal or security risk for us or other users — immediately where the situation warrants it, and otherwise with reasonable notice.
After termination we may delete your data. Export anything you need before you cancel, and contact us promptly at support@bluecollarapp.ai if you need help retrieving it.

16. Disclaimers

To the fullest extent the law allows, BlueCollar is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, secure, error-free, or that the AI will produce accurate results.

17. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, lost data, or missed jobs.
Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $100.
These limits don't apply to your obligation to pay for the service or to your obligations under Indemnification below.
Some states don't allow these limits, so parts of this section may not apply to you.

18. Indemnification

You agree to defend and indemnify BlueCollar and its owners, employees, and contractors against claims, damages, fines, and costs (including reasonable attorneys' fees) arising from your use of the service, your data, the content you publish, the work you perform for your customers, your breach of these terms, and in particular your calling, recording, and text-messaging practices.

19. Changes to these terms

We may update these terms. If a change is material, we'll give you reasonable notice by email or in the app before it takes effect. Continuing to use BlueCollar after that means you accept the updated terms.

20. Governing law and disputes

These terms are governed by the laws of the State of Colorado and the Federal Arbitration Act, without regard to conflict-of-laws rules.
Talk to us first. Before starting any claim, email support@bluecollarapp.ai with a description of the problem and what you want. We'll both try in good faith to resolve it within 30 days — nearly everything gets solved faster that way.
Binding arbitration. If we can't resolve it, any dispute arising from these terms or the service will be decided by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, in Colorado or by video. Judgment on the award may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small-claims court, and either party may ask a court for an injunction to protect its intellectual property or stop unauthorized use of the service.
No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and the arbitrator may not combine claims of more than one customer. If this waiver is found unenforceable for a claim, that claim goes to the state or federal courts in Colorado, not to arbitration.
Opting out. You can opt out of arbitration by emailing support@bluecollarapp.ai within 30 days of first accepting these terms, with your name, business name, and a statement that you opt out. If you opt out, or if arbitration doesn't apply for any reason, disputes go to the state or federal courts located in Colorado, and both parties consent to that jurisdiction.
Time limit. Any claim must be brought within one year after it arose, or it is permanently barred, except where the law doesn't allow a shorter period.

21. General

Entire agreement: these terms, together with our Privacy Policy and any plan or order details you accept, are the whole agreement between us about BlueCollar.
Severability: if a court finds part of these terms unenforceable, that part is limited as little as necessary and the rest stays in effect.
No waiver: if we don't enforce a term right away, we haven't given up the right to enforce it later.
Assignment: you may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of assets.
Events beyond control: neither party is liable for delays or failures caused by events outside its reasonable control, such as carrier or internet outages, power failures, natural disasters, or government action.
Electronic notices: you agree that we may give notices and agreements to you electronically — by email to your account address or in the app — and that they satisfy any requirement to be in writing.
Independent parties: we're independent contractors. Nothing here creates a partnership, employment, or agency relationship.
